This includes, but is not limited to, any warranties of: • merchantability • fitness for a particular purpose • condition or operability • safety or roadworthiness • accuracy of odometer reading Stewart Township makes no guarantees regarding the condition of any component, system, or accessory. Buyer Responsibility / Buyer Assumes All Risk By placing a bid, the bidder acknowledges: • They have either inspected the vehicle or chosen not to. • They accept the vehicle in its present condition. • They assume all risks associated with the vehicle upon transfer of possession. • They are responsible for all towing, transport, and removal arrangements. All sales are final. No refunds, returns, or exchanges will be permitted. Once the vehicle is paid for and removed from Township property, no claims of damage, defect, or mechanical condition will be accepted. Indemnification / Hold Harmless Clause By participating in this auction, the bidder agrees to indemnify and hold harmless Stewart Township, its officers, employees, and agents from any and all claims, damages, losses, liabilities, or expenses arising from the inspection, purchase, removal, transport, possession, or use of the vehicle. This includes, but is not limited to, claims related to: • personal injury • property damage • mechanical failure • accidents occurring during or after removal • any subsequent resale or operation of the vehicle Township Liability Protection Stewart Township shall not be liable for: • any injury, loss, damage, or expense arising from the use, operation, transport, or resale of the vehicle • any defects, known or unknown • any future mechanical issues, failures, or safety concerns • any delays or complications in the buyer’s ability to register, insure, or title the vehicle Once payment is received, the Township assumes no responsibility for theft, damage, or deterioration of the vehicle. Township Rights Reserved Stewart Township reserves the right to: • reject any and all bids • withdraw the item from auction at any time • cancel, postpone, or extend the auction • waive minor informalities • disqualify any bidder who fails to comply with auction terms The sale is not final until approved by the Stewart Township Board of Supervisors at a publicly held meeting. Payment and Pickup • Accepted Payment: Certified bank check or money order payable to Stewart Township • Payment Deadline: Payment must be received within 10 (ten) business days of notification of award • Removal Deadline: Vehicle must be removed within 14 (fourteen) business days of award unless otherwise arranged Failure to meet payment or removal deadlines may result in cancellation of the award. Title & Registration • Buyer is responsible for all title transfer, registration, taxes, and fees in accordance with Pennsylvania law. • Stewart Township makes no guarantee regarding the buyer’s ability to register or insure the vehicle.
