1. AWARD OF BID: The high bid is subject to approval by the Erie County Technical School Joint Operating Committee (JOC). The recommended award will be presented for consideration at the September 24, 2026, ECTS Joint Operating Committee Board Meeting, scheduled for 6:00 PM. 2. PAYMENT: Successful bidder shall remit payment by Cashier's Check or Money Order payable to "Erie County Technical School." Payment must be received within ten (10) business days of notification of award unless otherwise approved by ECTS. 3. AS-IS, WHERE-IS: The equipment is sold AS-IS, WHERE-IS, with no warranties expressed or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. ECTS makes no guarantees regarding condition, performance, operability, completeness, or suitability for any use. 4. INSPECTION: Prospective bidders are encouraged to inspect the equipment prior to bidding. Inspection appointments may be arranged through Erie County Technical School. 5. REMOVAL AND TRANSPORTATION: Buyer shall be solely responsible for all costs associated with rigging, loading, transportation, permits, and removal of the equipment from school property. Buyer shall provide any necessary equipment, personnel, and insurance required for removal. 6. REMOVAL DEADLINE: Equipment must be removed within thirty (30) days of payment unless alternative arrangements are approved by ECTS. Removal shall be coordinated with school personnel during normal business hours. 7. DAMAGE TO PROPERTY: Buyer shall be responsible for any damage to buildings, grounds, utilities, or other property occurring during removal of the equipment. Any damage caused by the buyer or the buyer's contractors must be repaired at the buyer's expense. 8. TRANSFER OF OWNERSHIP: Ownership of the equipment shall transfer to the successful bidder upon receipt of full payment by ECTS. 9. GOVERNING CONDITIONS: Submission of a bid constitutes acceptance of these terms and conditions and any additional terms established by Municibid. 10. SPECIAL REMOVAL REQUIREMENT: This hydraulic shear weighs approximately 14,550 pounds and is currently installed in the facility. Buyer is responsible for providing qualified rigging and transportation services. The school will not disconnect, dismantle, load, or ship the equipment.
