TERMS AND CONDITIONS
The Board of Commissioners will determine the highest responsible bidder for the property and has discretion to award the bid. The County reserves the right to withdraw the property from sale at any time and the right to reject all bids. The winning bidder will be contacted by the County if the sale was not approved.
A bid deposit of five percent (5%) of the amount of the bid must be paid within five business days after close of auction. The deposit of the bidder to whom the award is made will be held until the sale of the property is closed; if that bidder refuses at any time to close the sale, the deposit will be forfeited to the County. Final payment and close of sale must be accomplished within 60 days after close of auction. Bidder is responsible for all property survey, deed preparation and recording costs associated with the deed transfer. In addition, to be responsible, a bidder must be current on payment of all property taxes owed to the County. Bidders may inspect the property prior to bidding. Inspection is by appointment only. INSPECTION OF ITEMS, EQUIPMENT/VEHICLES:
Inspections are strongly recommended prior to bidding on the items, equipment/vehicles. The bid items offered may be inspected only during the hours of 8:30 a.m. to 2:30 p.m. Monday through Friday BY APPOINTMENT ONLY, at the LCRMS Landfill Site located at 447 Alexander Drive, Route 15 Highway, Montgomery, PA, 17752. To set up an appointment contact Lauren Strausser, Recycling Coordinator at Lycoming County Resource Management Services, at (800) 326-9571 or firstname.lastname@example.org (preferred). Appointments are required to be made 24 hours in advance.
Payment in full is due not later than 10 business days from the time and date of award. Payment must be made to the County of Lycoming by certified check or cashier’s check. Payment in full is required by the successful Buyer before any items, equipment or vehicles will be released by the County of Lycoming.
TRANSFER OF TITLE FOR VEHICLES:
The Buyer is responsible to satisfy the requirements necessary to effectuate legal transfer of title which include the following. The Buyer will need to accompany a County representative who is authorized to transfer the vehicle to a notary within our area for proper sign off by both parties with the paperwork being copied and then properly submitted to PA DOT for transfer from the County's name to the ensure all liability for the surplus vehicle has been removed from the County's name. Buyer will need to bring a valid driver’s license, proof of insurance to transfer the title. Buyer shall be responsible for any and all fees. Cash or check is required for fees, no credit cards are accepted. The County will not release any vehicles that have not been properly transferred by a notary.
Items, equipment/vehicles must be removed by appointment only and appointments must be made at least 48 hours in advance. All items, equipment/vehicles must be removed within 10 business days from the time and date of issuance of award. All items, equipment /vehicles must be picked up in one day (if possible unless special arrangements have been in in advance). The Buyer or the transport company picking up the items, equipment/vehicle will be required to sign off on a County Release form for each item received before said items would be released by the County.
The Buyer will make all arrangements and perform all work necessary, including packing, loading and transportation of the items, equipment or vehicle. No assistance from the County will be provided unless special arrangements have been made in advance between the Seller and Buyer. Adequate transportation is required for removal of said items. A daily storage fee of $25.00 to 100.00 (depending on this size of the item, equipment/vehicle purchased) may be charged for any item, equipment/vehicle not removed within the 10 business days allowed and stated on the Buyer's Certificate. If there would be any damage caused by the Buyer or any identity acting on the Buyer’s behalf to County property during the removal process of the sold items, equipment or vehicles, the Buyer would be responsible for the cost to repair the any damage to County property. Upon removal of items, equipment or vehicles, all sales are final.
GUARANTY WAIVER: All items, equipment/vehicles are offered for sale "AS IS, WHERE IS." Lycoming County, PA makes no warranty, guaranty or representation of any kind, expressed or implied, as to the merchantability or fitness for any purpose of the item, equipment/vehicle offered for sale.
Seller warrants to the Buyer that the items, equipment/vehicles offered for sale will conform to its description. Any claim for misdescription must be made prior to removal of the items, equipment/vehicle. If Seller confirms that the items, equipment/vehicles do not conform to the description, Seller will keep the items, equipment/vehicle and refund any money paid. The liability of the Seller shall not exceed the actual purchase price of the item, equipment/vehicle. Lycoming County reserves the right to accept or reject any or all bids.
The successful Bidder will indemnify, defend and hold the County of Lycoming, its Commissioners, its employees and agents harmless from all claims, demands, costs, expenses, liabilities and losses including reasonable attorney’s fees which may arise against the County, employees and agents as a consequence of any action or claim arising out of the successful Bidder malfeasance, neglect or omission.
The terms of the sales agreement shall be construed and interpreted under, and all respective rights and duties of the parties and shall be governed by, the laws of the Commonwealth of Pennsylvania.
RESOLUTION OF DISPUTES:
The terms of the sales agreement shall be construed and interpreted under, and all respective rights and duties of the parties shall be governed by, the laws of the Commonwealth of Pennsylvania. Each party to the sales agreement agrees to notify the other party in writing of all claims, counterclaims, disputes and other matters in question, with the other party having ten (10) days to respond in writing to initiate remedial actions or negotiate a resolution. Each party shall make efforts in good faith to resolve disputes in this manner. In the event that a dispute cannot be resolved, any and all suits or causes of action arising out of or in any way related to the sales agreement may be brought only in a court of competent jurisdiction having jurisdiction in Lycoming County, Pennsylvania.
