Item Description
DESCRIPTION
Used plastic and or steel 55 gallon drums that are empty, but may contain residue from products previously stored in these containers, consistent with the regulatory definition of empty (see below). Lids are non-removable (closed head). Sold for reconditioning/recyling purposes only not for reuse or repurposing. Requires a Certificate of Recycling from the Purchaser.
The said drums are sold for recycling only; Bidding is restricted to buyers who have a current scrap processing license, or drum reconditioning dealer license. At the end of the auction the successful bidder must submit this license prior to the award of the sale.
The successful bidder must submit a copy of valid recycling or dealer license within (24)
hours from the auction close date and time.
BIDDER WILL BE NON RESPONSIVE IF THE SAID DOCUMENTS ARE NOT RECEIVED WITHIN THE TIME ALLOWED.

CERTIFICATE OF RECYCLING
The Purchaser shall provide a Certificate of Recycling for the used empty drums included in this sale. The said empty drums requiring a certificate of recycling shall be reconditioned or recycled and not have any other use except for reconditioned drums. Purchaser shall be responsible to recondition or recycle the empty drums at the Purchaser’s facility.
The certificate must be on a company letter head signed by a duly authorized officer empowered to sign the document. The certificate must be provided within seven (7) calendar days of pick-up to Tasha Smith, Manager - Supply Chain Operations via e-mail tbsmith@transitchicago.com.
This certificate shall reference the CTA auction number, quantity, bill of lading number, pickup address, shipment pickup date, and ultimate destination. In addition CTA may exercise the right to witness the reconditioning or recycling process of the sold empty drums.
ENVIRONMENTAL REVIEW
As part of the bid evaluation process, the highest responsive bidder at the discretion of the Chicago Transit Authority Safety Department is required to supply environmental information related to the bidder’s recycling activities. The information requested relates to but is not limited to the bidder’s compliance of related State and Federal Regulations that correspond to the reconditioning or recycling activities performed at the highest responsive bidder’s site.
The requested information must be received by the Senior Manager, Environmental Compliance, Shile Liang, sliang@transitchicago.com within seven days of notification of the Environmental Review.
In addition to the requested environmental information the Chicago Transit Authority has the option of conducting an on-site Environmental Inspection of the recycler’s recycling facility.
Any bidder failing to provide the requested environmental information or who does not comply with proper environmental practices as revealed in the Environmental Inspection or environmental information will be bypassed from award consideration of the auction.
EMPTY DRUMS PER RESOURCE CONSERVATION AND RECOVERY ACT (RCRA)
Non-Acute Hazardous Waste
A container or an inner liner removed from a container holding nonacute hazardous waste as identified in Part 261, Subpart D, is empty when:
• All wastes have been removed using commonly employed practices and no more than 1 inch of residue remains; or
• No more than 3% the weight of total capacity of the container remains (when container size is 119 gallons or less); or
• No more than 0.3% by weight of total capacity of the container remains (when container size is 119 gallons or more)
Acute Hazardous Waste
A container or inner liner of a container holding acutely hazardous waste (i.e., all P- listed wastes and other hazardous wastes with the designated hazard code H) is empty when one of the following conditions is met:
• the container has an inner liner that prevents contact with the container and the liner is removed.
• the container has been triple rinsed with a solvent appropriate for removing the acutely hazardous waste.
• the container has been cleaned by another method that has been shown in the scientific literature, or by tests conducted by the generator to achieve removal equal to or better than triple rinsing.
INDEMNIFICATION
The Purchaser agrees to indemnify, save and hold harmless the CTA and its officers, agents and employees from any claims, lawsuits, costs, judgments, settlements or expenses (including but not limited to attorney’s fees), resulting from the sale of the material to Purchaser, the shipping of the material, the Purchaser’s handling, processing or resale of the material, or the condition, operation or use of the material thereafter.
GOVERNING LAW, CHOICE OF FORUM
This Agreement shall be governed in all respects by the laws of the State of Illinois, USA.
Any lawsuits shall be filled in courts or competent jurisdiction located in Cook County, Illinois, USA.
DISCLOSURE OF OWNERSHIP
The attached Disclosure of Ownership form (CTA 415.04) is part of the auction. The successful bidder is required to complete form and return via email to tbsmith@transitchicago.com within (5) calendar days from the end of the auction date. Please note that while there is no signature required, failure to address this will cause a delay in the award of the sale.
PICKUP INFORMATION
PICK UP IS BY APPOINTMENT (24) HOUR NOTICE IS REQUIRED.The Purchaser must provide a truck capable of accepting the complete load at the time of pickup. The CTA will load the drums on pallets from our warehouse standard height loading
dock. Removal must occur between the hours of 7am-1pm Monday-Friday only.
PICKUP APPOINTMENTS MUST BE APPROVED BY CTA PRIOR TO ARRANGEMENTS BEING MADE ON BEHALF OF THE BIDDER.
For 3rd Party Pickup:
Before the sold material will be released, the winning buyer will be required to send an e-mail (from the winning buyer's e-mail address used for the auction), identifying the representative authorized to pick-up paid item on their behalf. The authorized representative will need to bring the Notice of Award, Paid Receipt (photo copies are acceptable), bill of lading (for transport or shipping company), and their picture identification (such as a Driver License).
The Chicago Transit Authority reserves the right to reject any and all bids received. The Chicago Transit Authority also reserves the right to withdraw any auction, at any time, without notification obligation whatsoever.
ALL AUCTIONS ARE SUBJECT TO CHICAGO TRANSIT AUTHORITY APPROVAL EVEN IF THE ITEM IS BEING SOLD "NO RESERVE".
