Sale of Equipment The Municipality is offering one road grader for sale through public auction, sealed bid, or direct sale, as authorized by applicable laws and regulations. As-Is, Where-Is The road grader is sold "AS IS, WHERE IS," with all faults, known or unknown. The Municipality makes no warranties or representations, express or implied, regarding the condition, merchantability, fitness for a particular purpose, age, mileage, hours, or performance of the equipment. Inspection Prospective buyers are encouraged to inspect the equipment prior to submitting a bid or offer. Failure to inspect shall not relieve the buyer of responsibility for accepting the equipment in its current condition. Payment Full payment is due within 10 business days of award notification. Acceptable payment methods include certified check, cashier's check, or other methods approved by the Municipality. Check should be made payable to Penn Twp. Butler Co. Removal The buyer is responsible for all loading, transportation, permits, and removal costs. Equipment must be removed within 10 days of payment unless otherwise approved by the Municipality. No Returns All sales are final. No refunds, exchanges, or adjustments will be made after the sale is completed. Title and Transfer The Municipality will provide a bill of sale and any available ownership documentation as required by law. The buyer is responsible for registration, titling, taxes, and fees associated with ownership transfer. Right to Reject The Municipality reserves the right to reject any and all bids or offers and to withdraw the equipment from sale at any time before final acceptance. Indemnification The buyer agrees to hold harmless and indemnify the Municipality, its elected officials, officers, employees, and agents from any claims, damages, or liabilities arising from the purchase, transportation, ownership, or use of the equipment. Reserve price will not be disclosed. If being shipped all fees and arrangements are the responsibility of the awarded bidder. We can assist in loading. Not responsible for any damages incurred while doing so. Penn Township or its, employees, agents, board members and any other associated members are not responsible for sales taxes, notary, clerical or any other fees associated with the purchase. Penn Township is only responsible to produce a clean and free title for this vehicle unless otherwise stated.
